Background Checks – Region 8

Update on June 1, 2016 – For clarification, non-PA residents need: (1) what ever their state of residence requires to work with children (outlined below); AND (2) an FBI, fingerprint based, background check.

It has come to our attention that it is possible to use the PA “Cogent” system to get the FBI check even without being a PA resident (go to – https://www.pa.cogentid.com/index.htm) but, current processing times according to the PA Department of Human Services is approximately 3 weeks.

A new law in Pennsylvania has triggered a change to the background check policy that was in place in Region 8.  Effective January 1, 2015, a law requiring background checks on those with regular access to children (I am simplifying things for purposes of providing general information) is effective.  In addition to requiring reporting if an adult suspects a child is in imminent danger of being harmed, or is actually being harmed, there are now some specific requirements that appear to not only apply to the WTSDA, but all karate schools in PA.  That is, the WTSDA will need to begin to implement certain requirements for counselors and instructors at the Youth Dan Camps, and each individual studio owner should review with their attorney the potential requirement to get background checks on all instructors (over the age of 18).

Additionally, effective 5/16/16, a new law in Delaware requires Delaware businesses that deal with children to obtain background checks.  Please contact the LAC with questions, but like in PA, if you have a school in DE, you most likely need checks on your staff (volunteers or paid).

PENNSYLVANIA

THERE ARE THREE POTENTIAL ELEMENTS in PA.  CHILD ABUSE CLEARANCE, PA BACKGROUND CHECK AND FBI CHECK.

The Child Abuse Clearance and the PATCH check can be completed online.

FEDERAL BUREAU OF INVESTIGATION (FBI) CRIMINAL BACKGROUND CHECK INSTRUCTIONS

This is required for those who have not lived in PA for the last ten (10) years, continuously.  Those who have lived in PA for that 10 year period must submit an affidavit attesting to that fact.  This affidavit will be provided to you.  (Attached here: region 8 background affidavit.  Please note, if you are having notarized in a locale other than PA, you will need to change the notary’s block.)

The Pennsylvania Department of Human Services is utilizing Cogent Systems to process fingerprint-based FBI criminal background checks. DELAWARE

Like in PA, there are 2 required elements, plus the FBI background check referenced above.  The general background check and the sex offender registry.

BACKGROUND CHECK

The current (March 2015) fee for a State of Delaware Criminal Background Check is $52.50.

Where to go:

Kent County (no appointment needed)

The office is located at 655 South Bay Road, Suite 1B, Dover, DE 19901, in the Blue Hen Corporate Center. Enter the road between Kent County Levy Court and Firestone, then follow the fingerprint signs.

Sussex County (by appointment only)

The office is located at Delaware State Police Troop 4, in Georgetown, on the corner of Shortly Road and Route 113, across from Motor Vehicle Department.

New Castle County (by appointment only)

The office is located at  Delaware State Police Troop 2, on Route 40, in Bear, just west of the Fox Run Shopping Center, between routes 72 and 896.

SEX OFFENDER REGISTRY

The Delaware State Police Sex Offender Registry (SOR) is headquartered at SBI in Dover. The SOR is responsible for registration, notification, and verification of sex offenders throughout the state. The SOR also updates offender information on the Delaware public sex offender registry, which can be located at http://sexoffender.dsp.delaware.gov.

MARYLAND

BACKGROUND CHECK

Current fee for child care volunteer background checks if $33.00

If you live within Maryland:

*  You may go to any authorized location that provides fingerprinting services.

*  You may go to your local law enforcement agency to be fingerprinted on the state fingerprint card known as Form 015.

*  Once you’ve been fingerprinted, you may overnight it to CJIS-Central Repository located at 6776 Reisterstown Road, Suite 102, Baltimore Maryland 21215, or mail it to CJIS-CR P.O. Box 32708, Pikesville, Maryland, 21282-2708.

*  If you are requesting a copy of your FBI criminal history record you must send your request directly to the FBI.  (This is what the MD site notes, however, if you use the PA FBI/cogent system, this is acceptable to the WTSDA.)

If you live outside of Maryland:

*  You may write CJIS-Central Repository P.O. Box 32708, Pikesville, Maryland 21282-2708, or call the Central Repository in Baltimore City at 410-764-4501 or toll free number 1-888-795-0011 to reques t a fingerprint card.

*  You may mail the fingerprint card and associated fee to CJIS-Central Repository P.O. Box 32708 Pikesville Maryland 21282-2708, or overnight the fingerprint card to 6776 Reisterstown Road, Suite 102, Baltimore Maryland 21215.

*  Please include a check or money order made out to “CJIS Central Repository”.

NEW JERSEY

BACKGROUND CHECK

Current fee is $40.70.  A Form is required (which my be found here).

An individual may obtain a criminal history record check via electronic live scan at one of the approved sites. The New Jersey State Police uses the live scan fingerprinting services provided by , a private company under contract with the State of New Jersey. In order to be fingerprinted for one of the purposes listed above, you are required to contact Morpho Trust to schedule a time and place to have your fingerprints recorded. The quickest and easiest way to schedule your appointment is via the Web at www.bioapplicant.com/nj. Web scheduling is available 24 hours per day, seven days per week. Applicants who do not have Web access should call Morpho Trust at the company’s toll-free telephone number, 1-877-503-5981 (Monday through Friday, 8:00 a.m. to 5:00 p.m., and Saturday, 8:00 a.m. to 12:00 noon). Spanish-speaking operators are available upon request.

The background check currently costs $7 and detailed instructions on the procdure may be found at the website above.  Generally, requests for criminal record searches must be executed by the submission of a signed and notarized “Criminal Record Name Search” form SP-167.   1. The section for PA FBI check states if you are a 10+ year resident you don’t need the FBI check, but can supply an affidavit, which will be provided. Who provides the affidavit to me? Is it a blank form that specifys the information needed?
